1. Agreement to Terms

• Using our Services to distribute unsolicited commercial content or spam

• Harassing, threatening, or intimidating other users
• Uploading or sharing content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable

4.2 User Content

You retain ownership of any content you create or upload to our Services ("User Content"). By uploading or creating User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content in connection with providing and promoting our Services.

You are solely responsible for your User Content and the consequences of sharing it. We reserve the right to remove any User Content that violates these Terms or that we otherwise find objectionable.

5. AI Companions and Generated Content

Our Services include AI companions that generate text, images, voice, and other content based on your inputs. You understand that these AI companions:

• Do not represent real people
• May sometimes generate inaccurate, offensive, or inappropriate content despite our safeguards
• Should not be relied upon for critical decisions
• Are designed for entertainment purposes only

We own all rights to the AI models and systems, but you retain rights to your specific conversations and custom companions as described in our Privacy Policy.

6. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are owned by Candy AI, Inc. and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as permitted by these Terms.

7. Disclaimers and Limitations of Liability

Our Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not guarantee that our Services will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, we disclaim all liability for any damages, losses, or claims of any kind arising from or related to your use of our Services, including but not limited to direct, indirect, incidental, consequential, and punitive damages.

Some jurisdictions do not allow the exclusion of implied warranties or limitations of liability, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Candy AI, Inc. and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of our Services, your violation of these Terms, or your violation of any rights of another.

9. Termination

We may terminate or suspend your account and access to our Services at any time, without prior notice or liability, for any reason, including if you violate these Terms. Upon termination, your right to use our Services will immediately cease, and you must cease all use of our Services and delete any copies of our software in your possession.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
